The Egmont US Foundation’s Privacy Policy 

The Egmont US Foundation (“we”) promises to respect any personal information you share with us and to keep it safe. We aim to be clear when we collect your information and not do anything you wouldn’t reasonably expect. As such, we use your information in accordance with applicable data protection laws and regulations. This Privacy Policy explains our practices and the choices you can make about the way your information is collected and used by The Egmont US Foundation. It applies to supporter information that we collect both online and offline. 

We have updated our Privacy Policy to take into account the new requirements of the General Data Protection Regulation ("GDPR") which means if you are a resident of the EU and your donor records reflect that address, you may be entitled to certain additional protections in accordance with GDPR. 

What information is collected by The Egmont US Foundation? 

The type and quantity of information we collect and how we use it depends on why you are providing it. If you support us, for example by making a donation, or if you volunteer, fundraise, or attend an event, we will usually collect: 

  • Your name 

  • Your contact details 

We will mainly use your information to: 

  • Provide you with the information you asked for 

  • Administer your donation or support your fundraising 

  • Keep a record of your relationship with us, such as whether you have opened an Egmont email or clicked a link within an Egmont email 

  • Understand how we can improve the ways we communicate with our supporters. 

We may also use your personal information to detect and reduce fraud and credit risk. 

Whilst generally we will seek consent to process your data at the point we collect it, in some cases we may process data without consent when we are legally allowed to do so and where it is in our legitimate interests, provided we respect your legal rights. 

We collect information in the following ways: 

  • When you give it to us DIRECTLY 

You may give us your information in order to make a donation, attend an Egmont event or communicate with us. Sometimes when you support us, your information may be collected by an organisation working for us, but we are responsible for your information at all times. 

  • When you give it to us INDIRECTLY 

Your information may be shared with us by independent third parties, for example through fundraising sites like PayPal, through our email service, Mailchimp, or through other third parties at our events. They will do so pursuant to their own policies on data protection and privacy. It’s a good idea to check their privacy policy when you provide your information to understand fully how they will process your data. 

  • When you give permission to OTHER ORGANISATIONS to share your information or when it is available publicly 

We may combine information you provide to us with information available from external sources in order to gain a better understanding of our supporters to improve our fundraising methods, products and services. The information we get from other organisations may depend on your privacy settings or the responses you give, so you should regularly check them. This information comes from the following sources: 

  • Social Media 

Depending on your settings or privacy policies for social media and messaging services like Facebook, WhatsApp or Twitter, you might give us permission to access information from those accounts or services. 

  • Information available publicly 

This may include information found in publicly available government records and information that has been published in articles/ newspapers or on websites. 

  • When we collect it as you use our WEBSITES 

In common with most websites, The Egmont US Foundation website uses “cookies” to help us make our website – and the way you use it – better. Cookies mean that a website will remember you. They are small text files that sites transfer to your computer (or phone or tablet). In addition, the type of device you are using to access our website or apps and the settings on that device may provide us with information about your device, including what type of device it is, what operating system you are using, what your device settings are, or why a crash has happened. With whom do we share information? 

We do not trade, share, or sell information that you provide to us with other organizations who intend to use it only to market their products or services to you. 

There may be instances in which we share your information with others. We may share your information, for example, in conjunction with your sponsorship of a certain project, as required by law, with law enforcement, to comply with legal process, to protect our legal rights, to protect the safety or security of a person, or to protect against fraud, criminal acts, or misconduct. We may also share your information with companies that provide us with services, or with a successor legal entity. 

Where do we transfer and store information? 

The Egmont US Foundation is based in the United States, and maintains a close relationship with The Egmont Trust in the UK, which shares similar aims and values. The Egmont US Foundation has entered into a data sharing agreement with The Egmont Trust to share resources and better provide information on the work of partner organisation supported by The Egmont US Foundation. As such, personal data that we collect will be processed by staff, who are based at our offices in the UK. As such, the data that you provide is processed in the UK and protected by the UK Data Protection Act 2018. 

We have also contracted with a third party platform provider, Donorfy to manage our customer relationship management ('CRM') database and a company called Mailchimp to send email campaigns to our supporters. This means that your Personal Data may be hosted by Donorfy, or Mailchimp. Donorfy and Mailchimp are each signed up to the EU-US Privacy Shield Framework which means that they are committed to protecting personal data to standards that meet those applicable legal standards in the US and EU. You should be aware that, in general, legal protection for personal data under applicable law in the United States (and other non-EU countries) may not be equivalent to the protection provided in the European Union and/or under UK law. As such, the Data Sharing Arrangement between The Egmont US Foundation & The Egmont Trust provides additional protections to your Personal Information than may be provided under the applicable law in the United States. 

Lawful Basis for Processing Your Personal Information.  

The laws in some countries require us to tell you about the lawful grounds we rely on to collect, use, disclose, and otherwise process your Personal Information. To the extent those laws apply, our lawful bases for processing your Personal Information is in support of our legitimate interests, where those interests are not overridden by your fundamental rights and freedoms:  In many cases, we handle Personal Information because it furthers our legitimate business and charitable interests.  This includes: 

  • Providing a safe user experience on our site; 

  • Administration; 

  • Sending communications to you to let you know about what we are doing with your donations and to solicit additional donations; 

  • Protecting users, our workers, and our property; 

  • Analyzing and improving our operations (e.g., optimizing the design and operation of our site); and 

  • Managing legal issues. 

This Privacy Policy is issued on behalf of The Egmont US Foundation as controller of your Personal Information under applicable data protection laws.  A “controller” is the person or organization who alone or jointly determines the purposes for which, and the manner in which, any Personal Information is, or is likely to be, processed. 

Building profiles of supporters and targeting communications appropriately 

We use profiling and screening techniques to ensure communications are relevant and timely, and to provide an improved experience for our supporters. Profiling also allows us to target our resources effectively. We do this because it allows us to understand the background of the people who support us and helps us to send them relevant communications. Importantly, it enables us to raise more funds, sooner, and more cost-effectively, than we otherwise would.  

When building a profile we may analyse geographic, demographic and other information relating to you in order to better understand your interests and preferences in order to contact you with the most relevant communications. In doing this, we may use additional information from third party sources when it is available. Such information is compiled using publicly available information about you. 

Our commitment to data security 

To help prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect. For example, our online forms are always encrypted and our network is password-protected and routinely monitored.  

We will undertake regular reviews of who has access to information that we hold to ensure that your information is only accessible by appropriately trained staff, volunteers and contractors. 

We use external companies to collect or process personal information on our behalf. We do comprehensive checks on these companies before we work with them, and put a contract in place that sets out our expectations and requirements, especially regarding how they manage the personal information they collect or have access to.  We may need to disclose information if required to the police, regulatory bodies or legal advisors. 

We will only ever share your information in other circumstances if we have your explicit consent. 

Your access to data, and your choices 

If you would like to access the data that we received from you, or make corrections to it, you may contact us at the email or mailing addresses provided at the end of this policy. 

If you registered to receive communications from us and later change your mind, you may ask that your name and contact information be removed from our distribution list. You can send such a request to the email or mailing addresses at the end of this policy. 

Some web browsers and devices permit you to broadcast a preference that you not be "tracked" online. At this time we do not modify your experience based upon whether such a signal is broadcast. 

Policy Towards Children 

We are concerned about the safety and privacy of children who use the Internet. Although we encourage children to learn more about our organization and the partners that we support, we encourage that this be done with parental supervision. Consistent with the Children’s Online Privacy Protection Act of 1998 (“COPPA”), we will never knowingly request personally identifiable information from anyone under the age of 13 without prior verifiable parental consent. If we become aware that a child under 13 has provided us with personally identifiable information without verifiable parental consent, we will use our best efforts to remove such information from our files. Governing Law 

You agree that your use of this Website, this Privacy Policy, and any disputes relating thereto shall be governed in all respects by the laws of the State of New York. Any dispute relating to this Privacy Policy shall be resolved solely in the state or federal courts located in Manhattan, New York. 

Changes to this Privacy Policy 

We may change this Privacy Policy from time to time. If we make any significant changes in the way we treat your personal information, we will make this clear on the Egmont US Foundation website or by contacting you directly.
